IMPLEMENTASI PASAL 13A PERATURAN PRESIDEN NOMOR 14 TAHUN 2021 TENTANG PENGADAAN VAKSIN DAN PELAKSANAAN VAKSINASI TERHADAP MASYARAKAT

Coronavirus merupakan keluarga besar virus yang menyebabkan penyakit pada manusia dan hewan. Pada manusia biasanya menyebabkan penyakit infeksi saluran pernapasan, mulai flu biasa hingga penyakit yang serius seperti Middle East Respiratory Syndrome (MERS) dan Sindrom Pernafasan Akut Berat/ Severe Acute Respiratory Syndrome (SARS). Coronavirus jenis baru yang ditemukan pada manusia sejak kejadian luar biasa muncul di Wuhan Cina, pada Desember 2019. Metode penelitian ini menggunakan metode penelitian hukum normatif, permasalahan penelitian ini difokuskan dengan menerapkan kaidah-kaidah atau norma-norma dalam hukum positif. Hasil penelitian menunjukan bahwa dampak dari penolakan penerapan vaksinasi oleh masyarakat yang telah ditetapkan sebagai penerima vaksin menurut pasal 13A peraturan presiden nomor 14 tahun 2021 adalah a. penundaan atau penghentian pemberian jaminan sosial atau bantuan sosial; b. penundaan atau penghentian layanan administrasi pemerintahan; c. dan/atau denda” kemudian mengenai penerapan sanksi denda pasal 13A ayat (4) Huruf c peraturan presiden nomor 14 tahun 2021 penulis menilai sebuah kebijakan yang tidak tepat, karena dengan dibayarkannya denda oleh masyarakat penolak vaksin maka sudah sepatutnya masyarakat tersebut terbebas dari tuntutan untuk melaksanakan vaksinasi sehingga dapat dipastikan program vaksinasi yang diharapkan pemerintah dapat menanggulangan Pandemi Corona Virus Disease 2019 (Covid-19) akan sulit tercapai. Seharusnya sebaiknya Peraturan Presiden No.14 Tahun 2021 bagi masyarakat yang menolak di vaksin corona virus Disease 19 (Covid-19) tidak perlu mencantumkan sanksi denda terhadap masyarakat yang ditetapkan sebagai penerima vaksinasi covid-19 karena apabila masyarakat sudah membayar denda maka sepatutnya masyarakat tersebut tidak dapat dijatuhkan hukuman lagi terhadap pelanggaran yang telah dilakukan.

Corona viruses are a large family of viruses that cause disease in humans and animals. In humans, it usually causes respiratory tract infections, ranging from the common cold to serious illnesses such as Middle East Respiratory Syndrome (MERS) and Severe Acute Respiratory Syndrome (SARS). A new type of coronavirus found in humans since an extraordinary event appeared in Wuhan, China, in December 2019. This thesis research method uses normative legal research, meaning that the issues raised, discussed and described in this study are focused on applying the rules or norms in positive law. The results of the study show that the impact of refusing the application of vaccination by people who have been designated as vaccine recipients according to article 13A of presidential regulation number 14 of 2021 are a. postponement or termination of the provision of social security or social assistance; b. postponement or termination of government administration services; c. and/or fines” then regarding the application of fines in Article 13A paragraph (4) Letter c presidential regulation number 14 of 2021 the
author considers a policy that is not appropriate, because with the payment of fines by people who refuse vaccines, they should be free from demands to implement vaccination so that it is certain that the vaccination program that the government hopes to overcome the 2019 Corona Virus Disease Pandemic (Covid-19) will be difficult to achieve. Recommendation, it should be that Presidential Regulation No. 14 of 2021 for people who refuse the corona virus Disease 19 (Covid-19) vaccine should not include fines for people who are designated as recipients of covid-19 vaccination because if the community has paid the fine then the community should cannot be sentenced again for the violation that has been committed.
