ANALISA HUKUM TERHADAP KEWENANGAN KOMISI INFORMASI DALAM PENYELESAIAN SENGKETA INFORMASI DI PROVINSI SUMATERA SELATAN

Birokrasi merupakan instrumen penting dalam masyarakat yang kehadirannya tak mungkin terelakan. Birokrasi adalah sebuah konsekuensi logis dari diterimanya hipotesis bahwa negara mempunyai misi yaitu untuk mensejahterakan rakyatnya. Karena itu negara harus terlibat langsung dalam memproduksi barang dan jasa publik yang diperlukan oleh rakyatnya. Bagaimana analisa hukum terhadap penyelesaian sengketa informasi publik di Komisi Informasi Provinsi Sumatera Selatan. Faktor apa saja yang terjadi kendala dalam peroses Penyelesaian Sengketa Informasi Publik. Penelitian yang digunakan adalah metode penelitian hukum normatif. Penyelesaian Sengketa Informasi Publik dapat dilakukan melalui dua proses penyelesaian yaitu melalui proses litigasi berdasarkan Peraturan Mahkama Agung RI Nomor 2 Tahun 2011 Tentang Tata Cara Penyelesaian Sengketa Informasi Publik di Pengadilan dan non litigasi. Hambatan yang ditemukan dalam proses Penyelesaian Sengketa Informasi Publik. Antara lain hambatan yang ditemukan dapat terjadi karena kurangnya pemahaman pemohon keberatan terhadap proses administratif dalam pengajuan sengketa keterbukaan informasi publik yang menyebabkan salahnya prosedur penyelesaian yang dilakukan pemohon keberatan. Diharapkan kedepannya perlu dilakukan revisi undang-Undang nomor 14 tahun 2008 tentang keterbukaan informasi publik. Diharapkan untuk lebih ditingkatkan edukasi/sosialisasi kepada badan publik dan masyarakat sebagai pemohon atau pengguna informasi.

Abstract
Bureaucracy is an important instrument in society whose existence cannot be avoided. Bureaucracy is a logical consequence of accepting the hypothesis that the state has a mission, namely to prosper its people. Therefore the state must be directly involved in producing public goods and services needed by its people. How is the legal analysis of public information dispute resolution at the Information Commission of South Sumatra Province. What factors occur as obstacles in the Public Information Dispute Resolution process.The research used is a normative legal research method. Settlement of Public Information Disputes can be carried out through two settlement processes, namely through a litigation process based on the Supreme Court Regulation of the Republic of Indonesia Number 2 of 2011 concerning Procedures for Settlement of Public Information Disputes in Court and non-litigation. Barriers found in the Public Information Dispute Resolution process. Among other things, the obstacles found could occur due to the applicant's lack of understanding of the administrative process in filing a public information disclosure dispute which led to wrong settlement procedures carried out by the objection applicant. It is hoped that in the future it will be necessary to revise Law number 14 of 2008 concerning public information disclosure. It is hoped that there will be more education/ outreach to public bodies and the public as information applicants or users
